Hiring Your First Employee: A Guide to Social Security and SEPE Procedures

Taking the step to hire your first employee is a clear sign that your business as a freelancer or SME is growing. It's an exciting time, but it also brings new responsibilities and a series of administrative procedures you need to be aware of. Just as you once went through how to register as a freelancer step by step, now it's time to learn how to manage your obligations as an employer.

Here, we guide you through the key procedures with the Social Security Administration and the Public State Employment Service (SEPE).

1. Registering as an Employer with Social Security

Before you can register any worker, you, as a freelancer or SME administrator, must register as an employer with the General Treasury of the Social Security (TGSS).

* Procedure: You must apply for the company's registration to obtain your Contribution Account Code (CCC). This number will identify you as an employer and will be unique to your business nationwide.

* How is it done? It is done by submitting form TA.6 through the Social Security's Electronic Office. You will need to attach your NIF (Tax ID Number) and, if you are a company, the documentation proving your power of representation.

* Important: This is a one-time step, done only before hiring your first employee.

2. Registering the Employee with Social Security

Once you have your CCC, the next step is to register the employee in the General Social Security System.

* Deadline: This procedure is crucial and must always be completed before the employee starts their work activity, even if it's just a few minutes beforehand. A late registration can lead to penalties.

* Procedure: The registration is communicated using form TA.2/S through the Social Security's RED system. This form specifies the worker's details, the type of contract, and the contribution group.

3. Registering the Contract with SEPE

In parallel, you must formalize the employment relationship with a written contract and report it to the Public State Employment Service (SEPE).

* Contract: Choose the contract type that best suits your needs (permanent, temporary, training, etc.). It must be signed by both parties.

* Communication to SEPE: You have 10 business days from the signing of the contract to register it with SEPE. The process is done online through the Contrat@ application.

Ongoing Obligations and the Digital Future

Hiring an employee doesn't end with the registration. From now on, you will have to manage monthly payrolls, pay social security contributions, and declare IRPF (personal income tax) withholdings (quarterly form 111 and annual form 190).
