What is the Intra-Community VAT Number (VIES) and How to Apply for It to Operate in the EU?

Find out what the VAT-ID or VIES is, why it's essential for freelancers and SMEs operating in the European Union, and how to apply for your ROI registration step by step.

If you are a freelancer or have an SME in Spain and plan to sell products or provide services to companies in other European Union countries, there is a procedure you cannot overlook: registering in the Registry of Intra-Community Operators (ROI). By doing so, you will obtain an intra-community VAT number, also known as a VAT-ID or VIES number.

This registration is fundamental for correctly managing VAT in your cross-border transactions and maintaining your business's competitiveness in the European single market.

What Exactly is the Intra-Community VAT Number or VIES?

The intra-community VAT number is not a new number, but your same Spanish NIF preceded by the prefix "ES". The key is that for it to be valid at a European level, it must be registered in the VIES census (VAT Information Exchange System).

The VIES is a European Commission database that allows businesses to quickly and easily verify the validity of the VAT numbers of their trading partners in other member states. Being registered is proof that you are a VAT taxable person authorized to carry out intra-community operations.

Why Do You Need to Be Registered in VIES?

The main reason is the application of the reverse charge mechanism. In practice, this means that:

* When selling to an EU company: If both you and your client are registered in VIES, you can issue the invoice without VAT. Your client will be responsible for self-assessing the tax in their country.

* When buying from an EU supplier: If you are both in VIES, you will receive the invoice without VAT. You will be the one to declare that input and output VAT on your quarterly return (form 303), resulting in a neutral effect.

Not being registered would force you to apply Spanish VAT on your sales, making your product more expensive, or to pay the VAT of your supplier's country on your purchases, greatly complicating your tax management.

How to Apply for Registration in the Registry of Intra-Community Operators (ROI)

The process to obtain the VAT-ID is done through the Spanish Tax Agency (AEAT) and is free of charge. Follow these steps:

1. Submit Form 036. This is the census declaration form for registration, modification, or deregistration. It's the same document you likely used when you were registering as a freelancer step by step.

2. Check box 130 to apply for ROI registration.

3. Indicate in box 582 the expected date of your first intra-community transaction. It is crucial to justify the need for registration, for example, by attaching pro-forma invoices, emails, or contracts with future European clients.

Once the application is submitted, the AEAT has a maximum period of three months to respond. During this time, an inspector may verify your activity. If you have not received notification within three months, the application is considered denied by administrative silence.

VIES and the New Invoicing Obligations

Operating correctly at a European level is as important as complying with national regulations. Tax digitalization is advancing, and with it, the mandatory adoption of electronic invoicing and VeriFactu systems. Remember that the deadline for companies to adapt is January 1, 2027, and for freelancers, July 1, 2027.
